The "Policy", or the "Privacy Policy"; means this privacy policy, including amendments,

Some information that we may collect, like your email address or your IP address, might
enable someone to identify you personally. We call this type of information "Personally
Identifying Information" and we use our best efforts to maintain the confidentiality of this
type of information. This category does not include any personally identifying information that

Rituul may use customer information for additional purposes that may be identified at or
before the time that the information is collected. Rituul also (i) may provide the postal code of
certain individual visitors of the Website to certain applicable dealership customers of Rituul
who advertise on the Website for the sole purpose of such dealers determining the effectiveness
of advertising on the Website; and (ii) uses information from customers for accounting and
transaction completion purposes.
5. PASSWORDS

We do not store your password in our databases. Instead, we store a unique "cryptographic"
generated from your password. Each time you login, we generate a cryptographic hash
from the password you enter, and compare it to the hash stored in our database. If they match, we
know you entered the right password.

It is not feasible to determine your password from the cryptographic hash that we store. Even
we don't know what your password is.

6. DATA TRACKING AND USE OF COOKIES, WEB BEACONS OR SIMILAR TECHNOLOGIES

advertisers. If you view these ads, the advertisers may assign a cookie. RITUUL does not control
these cookies, nor is RITUUL responsible for any marketing or other use of your name by these

8. WE VALUE YOUR CONSENT

disclose your Personal Information. You may, at any time, delete your user account here. Your
user account information will be maintained for 30 days after you deactivate your account, in
case you choose to reactivate the account. Then, (subject to any legal requirement for us to retain
these records), your Personally Identifying information will be deleted. We may store
anonymized Demographic Information indefinitely. Shared Information, such as your
submissions, listings, and comments, may remain on the Website after your account is deleted,
however.
9. STORAGE OF YOUR PERSONAL INFORMATION

11. MONITORING OF CALLS AND EMAILS INITIATED THROUGH THE WEBSITE

In order to manage fraudulent activity on the Website, Rituul reserves the right to monitor and
record calls and emails that occur through, or as a result of, the use of the Website.
Communications involving Private Sellers through the Website, via telephone or email may
be recorded or monitored by Rituul for fraud prevention purposes. If Rituul deems a user's
behavior or activity to be fraudulent in nature or not in compliance with the Privacy Policy or
Terms of Use, Rituul reserves the right to block or discontinue any further communications
through the Website by the user. Rituul also reserves the right, in its sole and absolute discretion,
to remove users or user accounts that are suspected of being fraudulent.
Private Sellers that choose to post a vehicle for sale on the Website are required to utilize our
Fraud management solution as part of their communications with interested buyers.
All recordings, email monitoring content and associated data are the property of Rituul and its
service provider Privatis.
Rituul’s use of a Fraud monitoring tools does not in any way guarantee prevention of fraud or
fraudulent activity. Users of the Website are therefore required to use caution and common sense
when using the Website, and when entering into correspondence or purchase or sale transactions
with third parties. In particular, users must exercise great care when revealing personal
information and when purchasing items listed for sale on the Website. Rituul publishes "for sale"
listings on the Website without verification or endorsement. Rituul cannot and does not
guarantee that these listings are accurate, or that the persons submitting or responding to these
listings are not acting under false pretenses.

reasonable time upon receiving the written complaint, the Privacy Officer will conduct an
investigation into the matter. Within a reasonable time of concluding the investigation, the
Privacy Officer will inform the complainant whether the complaint will be allowed or denied. If
the Privacy Officer considers the complaint to be well founded, Rituul will take appropriate

CONFIDENTIALITY

damages you may suffer if you communicate confidential information over the Internet or if

INTELLECTUAL PROPERTY INFRINGEMENT

You cannot post any content to the Website that infringes upon the intellectual property rights
of others. If we believe that you have posted infringing content, we may delete or modify your

TERMINATION

We may terminate this Agreement at any time by deleting your user account for breach of
these Terms or if you otherwise put Rituul at risk of legal exposure. We may also terminate this
agreement without notice to you if we decide to discontinue providing the Rituul Website. The
license you grant to us to use any User Content that you submit, all indemnities, and all terms
limiting Rituul liability shall survive termination of this Agreement.
DEFINITIONS

For the purposes of this Agreement:

"Rituul", "We", or "Us" means Rituul Corporation and its subsidiary, affiliated and successor
companies.

The "Website" means the Rituul website accessible at RITUUL.com and any associated or co-
branded features, applications, services or websites provided to you by Rituul.

The "Terms", the ";Terms of Use", or the "Agreement" means this Terms Of Use agreement,
including our privacy policy and any amendments, modifications, and any additional terms
which apply to particular features or services.

References to "posting" refer to the act of submitting material or making anything available to
or through the Website or other Rituul services or servers. This includes, without limitation:
submitting listings or other content, posting comments, and sending messages to other users
through the Website.

GENERAL

1. Nothing in these Terms shall be interpreted to prevent Rituul from taking any action
required to comply with any applicable legal requirement.
2. Our failure or forbearance to enforce any of these Terms shall not be considered a waiver
of any of our rights.
3. You agree that this agreement is provided to you in English. It is your responsibility to
ensure that you understand these Terms. If we provide a translation of these terms into
any other language, that translation is for your convenience only, and the English version

4. You cannot transfer or assign your rights and obligations under this agreement to any
other person without our consent.
5. You agree that Rituul may communicate with you about the Website and your user
account via the email address you provide to us.
6. Rituul may freely assign its rights and obligations under these Terms in the event that it is
party to a merger, acquisition, restructuring, sale of assets, or for any other reason.
7. If any provision of these Terms is declared by a court of competent jurisdiction to be
invalid, illegal or unenforceable, that provision shall be deemed to be severable, and the
remainder of these Terms shall remain valid and in full force and effect.
8. This Agreement, and all matters related to your use of the Website shall be governed by
and construed in accordance with the laws of the Province of Ontario, and the laws of
Canada applicable therein, without regard to any conflicts of laws principles. Any
disputes shall be heard at the Courts in Toronto, Ontario, Canada.
